Welcome to ModraShop. These Terms of Service (“Terms”) govern your use of modrashop.com/ (the “Site”) and any purchase you make from us. By using the Site or placing an order, you agree to these Terms, our Refund & Return Policy, our Privacy Policy, and our Shipping Policy. If you do not agree, please do not use the Site.

1. About Us
ModraShop (“we,” “us,” or “our”) sells home and garden furniture and outdoor products, such as gazebos, to customers in the United States.

2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that you can form a binding contract and that the information you give us is accurate and complete.

3. Products and Descriptions
We try to describe and photograph our products accurately, including dimensions, materials, colors, and specifications. However, colors may vary slightly by screen, and measurements may have small manufacturing tolerances. If a product you receive differs materially from its description, see our Refund & Return Policy.

4. Pricing and Payment

  • All prices are in U.S. dollars (USD).
  • Prices and availability can change without notice.
  • Taxes and shipping costs are calculated and shown at checkout.
  • Payment is due at the time of order. We accept the payment methods shown at checkout.
  • By submitting payment, you confirm you are authorized to use the payment method.

5. Pricing Errors and Order Acceptance
We may correct errors in pricing, descriptions, or availability at any time. If a product is listed at an incorrect price, we may cancel the order and issue a full refund, or contact you to confirm before shipping. Your order is accepted only when we ship it or send a shipping confirmation. We may refuse or cancel any order, including in cases of suspected fraud, stock issues, or unauthorized transactions.

6. Shipping and Delivery
Shipping methods, costs, and estimated delivery times are described in our Shipping Policy. Delivery dates are estimates, not guarantees. Many of our products are large and ship by freight. You are responsible for providing a correct, deliverable address and for being available to receive delivery. Please inspect your order on arrival and report any damage as described in our Refund & Return Policy.

7. Returns and Refunds
Returns are governed by our Refund & Return Policy. In summary: eligible items may be returned within 30 days of delivery, we do not offer exchanges, customers pay return shipping for change-of-mind returns, and ModraShop covers return shipping for damaged, defective, or incorrect items.

8. Assembly, Installation, and Safe Use
Outdoor structures and furniture can be hazardous if assembled or used improperly. You agree to:

  • Read and follow all assembly instructions, warnings, and manufacturer guidelines
  • Assemble and anchor products as directed, especially gazebos, pergolas, and canopies, which must be secured against wind
  • Follow local building codes, HOA rules, and permit requirements where applicable. You are responsible for determining whether a permit or approval is required for your installation.
  • Not exceed stated weight or load limits
  • Remove or take down canopies and covers in high winds, storms, or heavy snow
  • Keep children and pets away from unfinished or unsecured structures

Weather, snow, and wind exposure can damage outdoor products. Such damage is not a product defect unless the product was defective on delivery.

9. Warranty
Products may include a manufacturer’s warranty. Where a warranty applies, its terms will be listed on the product page or included with your order. Except as stated, and to the fullest extent allowed by law, products are sold “as is” without other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow these limitations, so they may not apply to you.

10. Intellectual Property
All content on the Site, including text, images, logos, graphics, and design, belongs to ModraShop or its licensors and is protected by U.S. and international law. You may not copy, reproduce, distribute, or use it for commercial purposes without our written permission.

11. User Conduct
You agree not to:

  • Use the Site for any unlawful or fraudulent purpose
  • Submit false information or use another person’s payment method without permission
  • Interfere with the Site’s security or operation, or attempt unauthorized access
  • Use bots, scrapers, or automated tools to collect data from the Site
  • Post reviews or content that is false, misleading, defamatory, or infringing

12. Reviews and User Content
If you submit a review or other content, you give us a non-exclusive, royalty-free right to use, display, and reproduce it in connection with our business. You confirm the content is truthful, based on your own experience, and does not violate anyone’s rights. We may remove content at our discretion.

13. Third-Party Links and Services
The Site may link to third-party sites or use third-party services (such as payment processors and carriers). We do not control and are not responsible for third-party content, products, or policies.

14. Limitation of Liability
To the fullest extent permitted by law, ModraShop and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, such as liability for death or personal injury caused by our negligence where state law prohibits limiting it.

15. Indemnification
You agree to defend and hold harmless ModraShop and its owners and employees from claims, damages, and expenses (including reasonable attorney’s fees) arising from your violation of these Terms, your misuse of the Site, or your improper assembly, installation, or use of our products.

16. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at support@modrashop.com and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought in the state or federal courts located in USA Columbus, 

17. Changes to These Terms
We may update these Terms at any time. The “Last updated” date shows the latest version. Your continued use of the Site after changes are posted means you accept them. Orders are governed by the Terms in effect when the order was placed.

18. Severability and Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our other published policies, are the entire agreement between you and ModraShop regarding the Site and your purchases.
